I have read the ROC materials provided to me as part of the ROC application and understand the nature of the programs that I am enrolling the Participant in.
I retain full supervisory responsibility for any and all activities that happen as a part of the ROC including, without limitation, all online and offline activities of the Participant and agree that the Association and its staff (including volunteers) (“Association Personnel”) shall not be responsible for supervising the Participant in any way whatsoever.
I understand that two-way audio and video conferencing classes and group sessions (such as those delivered over Zoom or other similar applications) will only be accessible by registered ROC participants and Association Personnel.
I agree that at all times during any ROC activity, the Participant shall be dressed appropriately and that no offensive or otherwise inappropriate content shall be visible or audible to other participants. I acknowledge and agree that Association Personnel shall have sole discretion in determining whether the Participant is in compliance with the aforementioned requirements and that Association Personnel may, in their sole discretion and without any notice or liability, turn off the Participant’s video until any such non-compliance is remedied, or if such non-compliance cannot be remedied, to remove the Participant from, or refuse access to the Participant to, the activity.
I acknowledge and agree that the Participant shall be expected to behave appropriately during all ROC activities and that the Association may, in its sole discretion, determine what constitutes appropriate and inappropriate behaviour. Association Personnel shall review our Code of Conduct with all participants at the start of ROC. All forms of bullying (including cyberbullying), whether or not during a ROC activity shall be deemed as inappropriate behaviour. Any issues with the Participant’s behaviour shall be addressed between the Association and you. I acknowledge that if the Participant behaves inappropriately, Association Personnel may, in their sole discretion and without any notice or liability, remove the Participant from, or refuse access to the Participant to, the activity.
I acknowledge and agree that it shall be my responsibility to provide all equipment necessary to enable the Participant to participate in the ROC including, without limitation, computers, tablets, internet access, headsets, earphones, microphones, digital cameras, desks, and chairs. I acknowledge and agree that I shall be solely responsible for any damage caused to such equipment.
I agree to follow, and to ensure that the Participant follows, the Welcome Friend Association Electronic Communication Policy, which provides as follows:
- All private (one to one) electronic communications between the Participant and Association Personnel including, without limitation, communications through social networking platforms such as Facebook, Instagram, Snapchat, instant messaging, texting, email and other similar electronic means are prohibited.
- All communications between Association Personnel and the Participant must be transparent and public. Example: communication on group sites where anyone who is a member can see the conversation are permitted
- Email communication is preferred to be between the custodial parents / legal guardians of the Participant and Association Personnel. Email communications to the Participant must include at least one pre-approved Association Personnel
- Association Personnel and the Participant may communicate in two-way audio and video conferencing classes and group sessions (such as over Zoom) so long as such classes/sessions are facilitated by at least two pre-approved Association Personnel.
By registering for the ROC, (i) the undersigned agrees, or if there is more than one undersigned, (ii) the undersigned jointly and severally agree (in either case, “I”), as follows:
Voluntary Assumption of Risk.
I acknowledge and agree that the Participant’s participation in the ROC shall be at my and the Participant’s own risk and that I shall be solely responsible for any and all personal injury or damage to property as a result of the Participant participating in the ROC.
Release.
I, on my own behalf and on behalf of the Participant, hereby irrevocably and unconditionally remise, release and forever discharge the Association, its subsidiaries, affiliates, related entities, and each of their respective past and present officers, directors, employees, volunteers, administrators, agents, contractors, and as applicable, their respective successors, heirs, executors, successors and assigns (collectively, the “Association Parties”) of and from any and all claims, actions and causes of action, suits, proceedings, demands, damages, losses, liabilities, costs, charges, expenses, of every kind and nature whatsoever and however caused, at law or in equity, arising from, related to, or in connection with the Participant’s participation in the ROC including, without limitation, any of the matters set out above in this document, any death, personal injury, or damage to property (each a “Claim” and collectively, “Claims”).
I hereby irrevocably and unconditionally agree to fully indemnify and save each of the Association Parties harmless from and against any and all Claims and agree not to make any Claim or take any proceedings against any other person, partnership, body corporate or other entity that might claim contribution, indemnity or other relief from or against the Association Parties with respect to any matters herein released, and further agree not to claim contributions, indemnity or other relief whatsoever from or against any of the Association Parties with respect to any matters herein released in any proceeding brought by a third party.
General.
This document shall be governed by and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein. If any provision of this document is determined by a court of competent jurisdiction to be illegal, invalid or unenforceable, it shall be deemed severed and ineffective only to the extent of its illegality, invalidity or unenforceability without affecting the validity or the enforceability of the remaining provisions of this document.
I have read this document, fully understand its terms, and understand that I, on my own behalf and on behalf of the Participant, am giving up substantial rights including, among others, the right to commence legal action against the Association Parties, and undertaking substantial obligations including, among others, an obligation to indemnify the Association Parties. I acknowledge that I have had the opportunity to obtain independent legal advice regarding this document and have either done so or have waived my right to do so and that I am signing this document in good faith and under the my own free will.
